A donation gives you the opportunity to pass on assets to La Chaîne de l'Espoir during your lifetime. Find out how this altruistic gesture can change lives, and what steps you need to take to make a donation.

La Chaîne de l’Espoir only accepts donations under French law and can’t process testamentary donations from abroad.

What is a donation?

Making a donation during your lifetime is an irrevocable act carried out in the presence of a notary, enabling you to pass on assets free of charge during your lifetime, in complete security.
La Chaîne de l’Espoir benefits from article 795-4 of the Code Général des Impôts, which means that donations made to it, whatever their value, are totally exempt from gift tax.

What goods can you donate to La Chaîne de l’Espoir?

By donation, you can pass on :

  • Personal property such as a house or apartment, jewelry, furniture and works of art
  • Sums of money
  • Business-related assets, such as company shares

Please note:

  • You must provide proof that the property you are donating belongs to you.
  • If you are married under the reduced community of acquests regime, you can only give away property acquired during the marriage if your spouse has given his or her consent.
  • You must make sure that the gift you wish to make does not place you in a delicate financial situation.
  • If you have rightful heirs, only the available portion can be the subject of a gift.

Tax benefits

By making a donation, you can also benefit from tax advantages: donating a sum of money to an association entitles you to a tax deduction of 66% of the amount, up to a limit of 20% of your taxable income, with the possibility of carrying the excess forward for 5 years. In addition, La Chaîne de l’Espoir is exempt from transfer duties.

What are the different types of donation?

Gift of full ownership

Full ownership is the simplest and most common form of gift. You definitively and fully transfer the property of your choice to La Chaîne de l’Espoir.

What are the advantages?

  • Tax advantages: a gift of full ownership enables you to sell an asset without waiting for your succession. You can also benefit from tax advantages, such as reduced income tax, exemption from capital gains tax and transfer duties (notary’s fees).
  • Immediate transmission: as the gift is made during your lifetime, it is not subject to inheritance tax. The transfer of the property is immediate, requiring only the deed of gift, with no further steps or costs for either party.
  • Support a cause: you support our cause while enabling La Chaîne de l’Espoir to benefit from the income generated by your donation.
Gift of bare ownership with usufruct reserve

You transfer the bare ownership of your property to La Chaîne de l’Espoir, and retain the use of it (usufruct) for your own benefit or that of a third party until your death. This type of donation enables you to prepare for the transfer of your property, while retaining its use during your lifetime, and at the same time benefiting from the tax advantages associated with the transfer of bare ownership.

  • Long-term financial support: La Chaîne de l’Espoir can benefit from income generated by the usufruct of the property for the agreed period, which can provide a regular source of funding for our activities.
  • Tax advantages: you can benefit from tax advantages by reducing inheritance tax or benefiting from tax deductions.
    In addition, making your donation to La Chaîne de l’Espoir may enable you to benefit from an exemption from certain taxes on capital gains.
  • Perpetuation of philanthropic action: by transferring bare ownership to us with usufruct reserved, you prolong your philanthropic commitment and continue to support our cause of improving access to healthcare for children around the world, even after your death.
  • Transfer of assets with control: you have the option of transferring part of your assets while retaining control of the usufruct of the property until your death or for a specified period, enabling you to benefit from it during this period.
Temporary donation of usufruct

A temporary gift of usufruct enables you to grant a beneficiary the use of a property for a specified period, while retaining bare ownership. During this period, the beneficiary, known as the usufructuary, has the right to use the property and receive any income from it, but must return the property to the donor at the end of the agreed term. This form of gift enables the donor to temporarily pass on the benefits associated with the property, while retaining control over it in the long term.

    Transfer of responsibility: by temporarily entrusting us with the usufruct, you delegate the management and operation of your property for the agreed period, which can alleviate your responsibilities and commitments relating to the property during this time.
  • Support for a cause: thanks to your donation, you support our cause while enabling La Chaîne de l’Espoir to benefit from the income generated by the usufruct of the property for the agreed period.
  • Flexibility: a temporary gift of usufruct gives you the flexibility you need to plan the transfer of your estate, while retaining a degree of control over it. It allows you to adapt the terms of the gift to suit your needs and objectives.
  • Possibility of recovering the asset: at the end of the donation period, you regain full ownership of the asset, enabling you to use it freely or pass it on to your heirs.

Your questions, our answers

How can I make a donation to La Chaîne de l'Espoir?
  • Determine the type of donation: choose between a full ownership donation, a bare ownership donation or a temporary usufruct donation, depending on your objectives and the beneficiary’s needs.
  • Consult a notary: we recommend that you consult a notary for legal advice tailored to your situation, and to draw up the deed of gift in accordance with current legislation.
  • Prepare the necessary documents: gather together all the documents required for the donation, including identification, title deeds, any certificates of value for the property, etc.
  • Draw up the deed of gift:the notary draws up the deed of gift in compliance with legal provisions and the wishes of the parties involved. Once the dossier has been drawn up, it is presented to the Board of Directors of La Chaîne de l’Espoir for approval.
  • Sign the deed of gift: once the deed has been drawn up, all parties involved must sign it in the presence of the notary, who will then register the deed with the tax authorities so that it is valid and enforceable against third parties. The deed is also sent to the Préfecture de Paris, which issues a decision stating that there are no objections. The donation is then definitive.
  • Take care of tax formalities: make sure you meet the tax obligations associated with the donation, such as payment of gift tax and tax declaration, if applicable. If the donation involves a large sum of money, furniture or precious objects, La Chaîne de l’Espoir may request a notarized deed to avoid any subsequent dispute, particularly in the presence of heirs with reserved rights. If a donation to La Chaîne de l’Espoir affects the inheritance reserve of the donor’s children, the latter would then be entitled to take legal action to reduce the value of the donation, which could oblige La Chaîne de l’Espoir to return all or part of the donated property, even if the donation was made a long time ago (up to fifteen years before your death). To avoid any risk of your donation to La Chaîne de l’Espoir being called into question, you can offer to waive this right by means of a deed of anticipated renunciation of the action in reduction (RAAR). This deed, received by two notaries, is in principle irrevocable (articles 929, 930, 930-3 and 930-4 of the Code Civil).
